01 Who we are, and what this is #
In shortWe run the place where buyers and sellers meet. We do not sell the items ourselves.
mademarketnam.com operates an online marketplace on which individuals and businesses list items and services for sale, and on which buyers find them, contact the seller and agree a deal directly.
These terms apply to everyone who uses the marketplace, whether you are browsing, buying, selling or simply reading. By using it you accept them. If you do not accept them, please do not use the marketplace.
02 We are not a party to your sale #
In shortThe contract is between the buyer and the seller. We are the introduction, not the shop.
When a buyer and a seller agree a deal, the contract of sale is between those two people. We are not the seller, we do not own the goods, we do not inspect them, and we are not a party to the agreement.
This matters practically: questions about condition, fitness for purpose, delivery, refunds and warranty are between the buyer and the seller. We provide tools to help — the messaging record, seller verification, reviews and the reporting system — but we cannot decide a dispute for you or compel either side to act.
Nothing in this section removes any right you have under consumer-protection law that cannot be excluded by agreement.
03 Your account #
In shortOne account, real details, your responsibility to keep it secure.
You must give accurate details when you register and keep them up to date. You are responsible for what happens under your account, so keep your password to yourself and tell us promptly if you believe someone else has access to it.
You must be old enough to enter a binding contract in your country. Accounts may not be shared, sold or transferred.
You may close your account at any time. Closing it does not remove listings or messages that are the subject of an unresolved dispute or a legal obligation to retain.
04 Listing an item #
In shortDescribe it honestly, own it or be entitled to sell it, price it clearly.
A listing must describe the item accurately, including faults. Photographs must be of the actual item, not taken from a catalogue or another listing.
You must own the item or be entitled to sell it, and you must be able to deliver what you have described at the price shown.
Prices must include everything the buyer is expected to pay for the item itself. If delivery costs extra, say so in the listing.
We may edit, recategorise, hide or remove a listing that breaches these terms, is miscategorised, or is reported and found to be misleading.
05 What may not be listed #
In shortAnything illegal, dangerous, stolen, counterfeit, or that we are not willing to host.
You may not list anything that it is unlawful to sell where you are, or anything that infringes another person's rights. That includes stolen goods, counterfeit items and pirated media.
You may not list firearms, ammunition or explosives; controlled drugs or drug paraphernalia; prescription medicines; live animals; human remains or bodily fluids; hazardous chemicals; tobacco or alcohol where a licence is required and you do not hold one; identity or government documents; personal data or account credentials; sexual services; or anything that promotes hatred against or violence towards any group.
This list is not exhaustive. We may refuse or remove anything we reasonably consider unsafe, unlawful or inappropriate for the marketplace, and we may report serious matters to the authorities.
06 How people are expected to behave #
In shortBe straight with each other. Keep the conversation on the platform.
Treat other users civilly. Harassment, threats, discriminatory abuse and repeated unwanted contact are not tolerated and will cost you your account.
Do not use the marketplace to send unsolicited advertising, to scrape data, to interfere with the service, or to attempt to gain access to anyone else's account.
Keep negotiations in the built-in messaging. It is not there to monitor you; it is there so that if a deal goes wrong there is a record both sides can point to. Moving straight to another channel is the single most common feature of a scam.
Never send money in advance to somebody you have not met, and never share one-time codes or banking credentials with a buyer or seller.
07 Fees and paid promotion #
In shortListing is free. Only optional promotion costs money, and the price is shown before you pay.
Creating an account and posting a listing are free, and we take no commission on a completed sale.
We offer optional paid promotion that places a listing more prominently. The price, the duration and what you get are shown before you pay. Promoted listings are labelled so that buyers can see them for what they are.
Payments for promotion are handled by a third-party payment provider. Refunds for promotion are at our discretion except where the law requires otherwise, and we will not refund a promotion that has already run.
08 Reviews and reputation #
In shortReviews come from real deals. We do not delete a bad one because a seller asked.
Reviews may only be left after a genuine transaction, and must describe your own experience honestly.
You may not write reviews about your own store, arrange reciprocal reviews, or offer anything in exchange for a review.
We remove reviews that are abusive, contain personal data, are plainly fabricated, or breach the law. We do not remove a review simply because it is unflattering.
09 Reports and moderation #
In shortAnyone can report anything. Reports are read by a person, and reporters stay anonymous.
Every listing and every store carries a report link. Reports reach the moderation team, and the person reported is not told who raised it.
We may suspend or remove content, and suspend or close accounts, where we reasonably believe these terms have been breached. Where it is appropriate and lawful to do so, we will tell the account holder why.
If you believe we have acted wrongly, write to us at klausmsitemba@gmail.com and a person will look at it again.
10 Intellectual property #
In shortYour photos stay yours. You let us display them so the marketplace can work.
You keep ownership of the photographs and text you upload. By posting them you give us a non-exclusive, royalty-free licence to host, display, resize and distribute them for the purpose of operating and promoting the marketplace.
You confirm that you have the right to grant that licence and that your content does not infringe anyone else's rights.
The marketplace software, design, name and logo belong to us and may not be copied or reused without permission.
If you believe content on the marketplace infringes your rights, write to klausmsitemba@gmail.com with enough detail to identify it and we will act promptly.
11 Availability of the service #
In shortWe aim to keep it running, but we cannot promise it never breaks.
We work to keep the marketplace available and secure, but we do not guarantee uninterrupted access. Maintenance, faults and events outside our control can interrupt it.
We may change, suspend or withdraw features. Where a change is significant and we can give notice reasonably, we will.
12 Our responsibility to you #
In shortWe are responsible for our own service. We are not responsible for the items people sell.
We are responsible for providing the marketplace with reasonable care and skill. We are not responsible for the accuracy of a listing, the condition or legality of an item, or the conduct of a buyer or seller, because these are not ours to control.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, data or opportunity arising from your use of the marketplace.
13 Suspension and closure #
In shortSerious or repeated breaches cost you access.
We may suspend or close an account that breaches these terms, that puts other users at risk, or that is used unlawfully. Where the breach is serious we may do so without notice.
You may close your own account at any time from your dashboard.
14 Changes to these terms #
In shortThey can change. Material changes get notice, and the date at the top always tells you.
We may update these terms as the marketplace develops or the law changes. The date at the top of this page always shows when they were last updated.
Where a change materially affects your rights we will give reasonable notice, by a notice on the site or by email. Continuing to use the marketplace after a change takes effect means you accept it.
15 Governing law and how to reach us #
In shortLocal law applies. Write to us and a person will answer.
These terms are governed by the laws of the country in which the marketplace is operated, and the courts of that country have jurisdiction. This does not remove any protection you have under the mandatory law of the country where you live.
